Le délai pour un dépôt de plainte avec constitution de partie civile est encadrée par une limite temporelle appelée prescription. Passé ce délai, il n’est plus possible d’effectuer un dépôt.
Sauf situation particulière, le délai de dépôt de plainte avec constitution de partie civile est de :
- 1 an pour les contraventions ;
- 6 ans pour les délits ;
- 20 ans pour les crimes.
Exceptées pour certaines infractions dites dissimulées ou occultes (au sens de l’article 9-1 du Code de procédure pénale), le délai court à compter du jour où l’infraction est commise.
Pour les infractions commises sur les mineurs, le délai court à compter de la majorité.
